It can be a very frightening scenario when a tree comes crashing down on a house.

Depending on where the tree was located on the property, it can also quickly spark a discussion around who is liable for the damages — especially if there is a hefty repair bill.

This post will explore some of the things to consider when assessing damages due to a fallen tree.

Situations where home insurance covers the damages

If an otherwise healthy tree falls in a storm just due to the severity of the wind and conditions, then you can expect damages to be covered by your Ontario home insurance policy. In this case, the natural event is deemed to be at fault.

Note that this is for cases where a tree has fallen and caused damage to the home. Your home insurance policy cannot be expected to cover the cost of removing the tree from the property. This cost will typically fall on the responsibility of the homeowner.

Situations where a property owner is liable

If a tree falls due to neglect or a lack of maintenance, home insurance will not necessarily cover the damages. And if the tree falls onto a neighbouring property and causes damages, the owner of the property where the tree was located will be liable.

What can I do if I am worried about a tree on my neighbour’s property?

The best option is to raise the issue with your neighbour and have a discussion. In most cases, this should lead to a resolution for either removing the tree, or otherwise making it safer.

If you have already had a discussion with your neighbour and can’t come to an agreement, you are not legally allowed to remove or damage it without their permission. You are allowed to trim any branches that extend into your property, however.

What do I do if a tree has already fallen?

First things first, you’ll want to document any damages clearly showing the day and time. This is important for recordkeeping. If a tree has fallen onto your property, you can also get in touch with an Ottawa arborist to assess the tree and see if there is a clear conclusion as to why it fell.
